USER AGREEMENT
1. General Provisions
This User Agreement has been developed by Int Line Limited Liability Company (TIN 3900009097, PSRN 1233900003480), the holder of the exclusive right to the software "HotelPMS Online Booking Module". This software allows prospective customers of hotel services, or of short-term residential rentals, to make bookings online by themselves. This User Agreement constitutes a public offer in accordance with Article 437 of the Civil Code of the Russian Federation. Int Line LLC may amend this User Agreement at any time at its own discretion without notifying users. The new version of the User Agreement takes effect on the day it is published on the Internet.
The user is a legally capable individual aged 18 or over who purchases hotel services or rents residential premises in their own name or in the name of third parties, for personal, household or other needs not related to business activities. By using a personal computer or mobile device (smartphone, tablet, etc.) to access the website of an accommodation facility or landlord, and by using the "HotelPMS Online Booking Module" software to search for, select, book and pay for hotel services or pay for the short-term rental of residential premises, the user agrees to the terms of this User Agreement.
2. Terms and Definitions
Accommodation facility means a business entity (legal entity or individual entrepreneur) that provides people who are away from home with a range of services, the most important of which are accommodation and catering.
Landlord means a legal entity, individual entrepreneur or individual who owns or manages residential premises (rooms, apartments, houses, parts of a house) and provides such premises to people for use under a rental agreement.
Operator means a legal entity that processes personal data.
Service means a set of software tools for online booking.
Administrator means an authorized person responsible for the operation of the Service.
The user must carefully read all provisions of this User Agreement before completing the booking process. The user must also read the online booking rules, any special offers and their terms, and the booking cancellation rules. These rules may be posted on the accommodation facility's website or in the online booking form. If the user disagrees with any provision of this User Agreement, the user must stop using the "HotelPMS Online Booking Module". Continued use of the "HotelPMS Online Booking Module" shall be unambiguously deemed acceptance of all terms of this User Agreement.
2. Booking
2.1. The website of an accommodation facility (landlord) is any page or set of pages on the Internet containing information about the accommodation facility (residential premises). The website may belong to the facility or landlord, or to a third party acting on its behalf.
2.2. The HotelPMS Online Booking Module is a software tool linked from the website of the accommodation facility (landlord) selected by the user. The link may be implemented either as a graphic link (widget) or using iFrame technology.
2.3. Booking means a set of actions performed by the user through the online booking module that results in information being transferred automatically:
to the managers of the accommodation facility selected by the user, regarding the rooms and/or services of that facility that have been ordered, or
to the landlord, regarding the residential premises the user has selected for a short-term rental agreement.
2.4. Int Line LLC does not charge users for the use of the "HotelPMS Online Booking Module". Int Line LLC is not liable for any actions or omissions of the possessors or owners of accommodation facilities or residential premises.
2.5. To make a booking, the user must fill in a special form in the online booking module. The user assumes full responsibility for the accuracy, completeness and reliability of the data entered. Before completing the booking process, the user must carefully read all online booking rules, any special offers and their terms, and the booking cancellation rules. These rules may be posted on the website of the accommodation facility (landlord), in the online booking form or in the booking confirmation.
2.6. Users are prohibited from:
reselling rooms (services) booked through the online booking module;
entering into sublease agreements for booked residential premises;
sending automated mass requests;
using bots and scripts;
posting false information;
infringing copyright.
2.7. The person who created materials and/or added them to the online booking module bears full responsibility for their content and for its compliance with applicable law.
2.8. The Service Administrator reserves the right to delete any User materials, or temporarily restrict access to them, unilaterally and without explanation.
2.9. If the User repeatedly or grossly violates the terms of this Agreement and/or legal requirements, Int Line LLC reserves the right to block the User's entire account (profile), delete it, or otherwise restrict or terminate the User's access to the online booking module.
2.10. If Int Line LLC is held liable or penalized because the User violated the rights and/or interests of third parties, or breached prohibitions or restrictions established by law, the User shall compensate Int Line LLC in full for the losses incurred.
3. Agreement and Payment
3.1. During online booking, an agreement is concluded between the user and the accommodation facility or landlord selected by the user. This is either an agreement for hotel and related services or a rental agreement for residential premises. All information about the selected accommodation facility or residential premises used for online booking is provided by that accommodation facility (landlord), which is responsible for its accuracy. This includes photos, descriptions of the facility or premises, related services offered (where a hotel services agreement is concluded), prices, etc. All obligations to provide hotel and related services, or arising under the rental agreement, fall directly on the accommodation facility or landlord selected by the user. The user must submit any claims directly to the selected accommodation facility (the landlord of the selected accommodation facility).
3.2. The order may be paid for by any of the methods determined by the accommodation facility (landlord).
3.3. During online booking, the user may pay only part of the cost of the booked rooms (services) or only part of the rental period. In that case, the user must pay the remaining amount directly at the accommodation facility (or to the tenant upon arrival at the residential premises), in cash or by bank card, in the manner established by the accommodation facility (tenant).
3.4. The user may pay for rooms, services or the right to use residential premises by bank card or electronic money through the online booking module using internet acquiring. In that case, the user makes the payment in the payment system window that opens, using their own bank card or e-wallet. The amount paid is the cost of the first night at the accommodation facility (the first night of use of the residential premises), or another amount specified by the accommodation facility (landlord) in the online booking form.
3.5. When paying on site for booked rooms, services or the right to use residential premises, the user pays in cash or by bank card. Payment is made directly upon arrival at the accommodation facility, or to the landlord (or a person authorized by the landlord) upon moving into the residential premises.
3.6. Russian Federation law provides for guaranteed bookings, under which the hotel holds the room for the consumer until check-out time on the day after the scheduled arrival day. For such bookings, in the event of late cancellation, late arrival or no-show, the consumer or the customer is charged a fee for the time the room (bed in the room) actually stood unused, but not more than for one night. Other countries may have different rules governing non-refundable rates. Users are asked to review carefully the cancellation rules of the accommodation facilities they select.
3.7. In the Russian Federation, if the user cancels a booking or withdraws from a rental agreement for residential premises, the landlord may recover the actual expenses incurred in performing that agreement. The landlord may either withhold this compensation from amounts already paid or claim it from the user. Other countries may have different rules governing compensation of landlords' expenses. Users are asked to review carefully the cancellation rules for the residential premises they select.
3.8. The accommodation facility reserves rooms directly at the time of booking. A booking confirmation is sent to the email address the user provided during booking. The user is advised to print the booking confirmation and keep it until check-in at the accommodation facility.
3.9. The landlord reserves residential premises under a rental agreement directly at the time of booking. A booking confirmation is sent to the email address the user provided during booking. The user is advised to print the booking confirmation and keep it until moving into the residential premises.
4. Changes to a Booking
4.1. The online booking module does not allow changes to a booking that the user has already made and the accommodation facility (landlord) has confirmed.
4.2. To book an additional room (additional residential premises) or additional nights at the accommodation facility (residential premises), the user must make a separate online booking.
4.3. To change a booking that has been made and confirmed, the user must agree on the changes directly with the accommodation facility (landlord). The user may use any means of communication listed in the booking confirmation that are available to both the user and the accommodation facility (landlord).
5. Booking Cancellation
5.1. The user should cancel bookings through the online booking module. This avoids breaches of the cancellation procedure and the resulting adverse consequences and disputes with the accommodation facility (landlord). To cancel, the user needs the email address provided during booking and the booking number. After cancellation, a cancellation notice is sent to the user by email.
5.2. Refunds are made in the manner established by the accommodation facility (landlord).
5.3. The accommodation facility (landlord) may apply penalties under its own rules in the event of late cancellation, early departure, or a no-show by the user and/or accompanying persons.
6. Cost of Rooms and Services, or Rent for Residential Premises
6.1. All prices shown in the online booking module are set independently by the accommodation facilities (landlords). They apply to all bookings made through the online booking module according to the parameters set by the accommodation facilities (landlord).
6.2. Bookings are made at the prices in effect for the period of the intended stay. Any special price offers set by accommodation facilities (landlords) through the online booking module are applied automatically at booking.
6.3. Prices for bookings via the online booking module are shown in the currency chosen by the accommodation facility (landlord).
6.4. Accommodation facilities (landlords) usually display final prices for rooms, services or rent during online booking. However, prices for accommodation facility services may not include certain taxes and fees imposed by local authorities.
7. Protection of Confidential Information
7.1. The user agrees to this User Agreement by continuing to use the online booking module. By doing so, the user consents to the following processing of their personal data (surname, first name, patronymic, email address and telephone number): collection, systematization, accumulation, storage, clarification (updating, modification), use, transfer to the accommodation facility (landlord) and third parties, anonymization and destruction. This personal data is obtained to provide the user with the services requested (or to conclude a rental agreement) or to respond to the user's inquiries. The data appears in the booking confirmation and in reporting and accounting documents. The user gives this consent for any lawful actions with personal data aimed at the purposes set out in this User Agreement. These purposes include the user's online booking of hotel and related services, the conclusion of a rental agreement for residential premises, and the preparation of reporting and accounting documents. When using the online booking module, the user is deemed to have accepted the terms of this Offer regarding personal data processing in full, without exceptions or reservations.
7.2. Data entered by the user is transmitted to the software used by the selected accommodation facility or landlord. Only the data needed to book rooms (services) at the facility or to conclude the rental agreement is transmitted. Data entered by the user may be transferred to a third party solely to perform the agreement between the user and the accommodation facility (landlord). In online booking, the operator of personal data is the owner or possessor of the accommodation facility, or the landlord of the residential premises, selected by the user. Under Russian law, Int Line LLC is a "person acting on behalf of the operator". The owner (possessor) of the accommodation facility or residential premises is responsible to the data subject for the processing of their personal data.
7.3. Int Line LLC takes necessary and sufficient organizational and technical measures to protect the user's personal information. These measures guard against unlawful or accidental access, destruction, modification, blocking, copying, distribution and other unlawful actions by third parties.
8. Use of Cookies
8.1. The "HotelPMS Online Booking Module" software uses cookies. Cookies are small text files stored in the browser that let a website remember details of a visit from the user's computer or from an app on a mobile device. The cookies used by the online booking module are linked only to an anonymous user and their computer. They contain no references that could reveal the user's personal data.
8.2. The online booking module platform may use the following types of cookies:
cookies needed to collect non-personalized information about which Internet resource the user came from to reach the online booking module;
cookies that enable web analytics tools. These are used for general analysis of how users use accommodation facility (landlord) websites and the online booking module, and to gather baseline data for improving offers to users. Information obtained this way may be sent in anonymous form to a web analytics service server, where it may be stored and processed. The copyright holder of the online booking module software may use analytics tools and related cookies from the following service provider: Yandex.Metrica.
8.3. All modern browsers allow the user to change cookie acceptance settings or disable cookies entirely. These settings are usually found in the browser's "Options" or "Settings" menu. However, disabling cookies while using the online booking module may cause certain sections or functions of its software to work incorrectly.
9. Miscellaneous
9.1. A registered User independently determines the terms and procedure for using the account (profile) created for them. However, these may under no circumstances contradict this Agreement.
9.2. Governing Law. This Agreement, the procedure for its conclusion and performance, and all matters not covered by this Agreement are governed by the laws of the Russian Federation.
9.3. Dispute Resolution. All disputes arising under or in connection with this Agreement shall be heard by the Arbitrazh (Commercial) Court in accordance with applicable law.
9.4. Amendments. The Service may amend or terminate this Agreement unilaterally, without prior notice to the User and without paying any compensation.
